En Este trabajo la autora señala que en el significado del término proporción se convierte la clave para resolver adecuadamente la tensión que obliga al juez a adaptar la generalidad y abstracción de la norma a la particularidad del caso concreto. Mediante el juicio ponderativo, que exige la búsqueda de la proporción, se produce la necesaria progresión que supone avanzar desde una dimensión estática a una dinámica de justicia. Y esa progresión, el juez desbroza el camino, abre el sendero hacia la resolución del caso, sopesando los bienes jurídicos en pugna, primando el interés más digno de protección atendidas las circunstancias concurrentes, y convirtiéndose la función jurisdiccional finalmente en una función creadora y rejuvenecedora del Derecho.
