Trotz § 217 n.F. StGB ist die Suizidteilnahme in Deutschland grundsätzlich straflos. Die Abgrenzung der straflosen Beihilfe zum Suizid von der strafbaren Mitwirkung am Suizid stellt ein schwieriges Problem dar. Die jüngste Rechtsprechung geht dabei davon aus, ob das konkrete Suizidgeschehen von dem Suizidwilligen »freiverantwortlich« umgesetzt wurde oder nicht. Die Freiverantwortlichkeit des Suizidentschlusses durch den Suizidwilligen ist entscheidend für die Straflosigkeit des Beteiligten am Suizid. Im Fokus der vorliegenden Publikation steht die Beurteilung dieser Freiverantwortlichkeit. Der Autor thematisiert die Problematik im allgemeinen Trend zu einer stärkeren Gewichtung der Selbstbestimmung am Lebensende und schlägt als neues Kriterium »die Überwindbarkeit« des Suizidenten vor.
