Desde mis primeros estudios referentes al Derecho, me llamó la atención la disconformidad que existe entre los principios de penalidad que todos reconocen y admiten y el verdadero fin social de esta ciencia. Las líneas generales del sistema que después he procurado desarrollar las tracé en algunos ensayos críticos. Mi Criterio positivo della penalit á (Nápoles, 1880) fue mi primer ensayo de una nueva teoría de la represión, pero sólo más tarde he podido desarrollar aquel plan. La Criminología (Turín, 1885) ha suscitado muchas críticas por parte de los juristas, así como también muchas objeciones por parte de los sabios, las cuales me han dado ocasión para mejor explicar y desarrollar mis ideas, y quizá para rectificar algunos errores de detalle.RAFFAELE GAROFALO
