Seit jeher ist die straftheoretische Fundierung des poena naturalis-Gedankens innerhalb des Strafrechtsystems umstritten. Bereits prima facie scheint eine zufällige, nicht durch eine übergeordnete Instanz verhängte Strafe nur schwerlich geeignet zu sein, die Funktion einer staatlichen Strafe zu erfüllen. Gleichwohl hat dieses Phänomen durch 60 StGB Einzug in das geltende Strafrechtsystem gefunden. Im Fokus der Arbeit steht die Frage, ob die poena naturalis einen legitimen Stellenwert innerhalb des Strafrechts, insbesondere als Absehensgrund von Strafe im Rahmen von 60 StGB hat bzw. haben kann, was nach ausführlicher Untersuchung verneint wird. Die poena naturalis ist und bleibt eine systemfremde Figur, welche keinerlei Daseinsberechtigung im geltenden Strafrecht hat.
