Synopsis "LA PROTECCIÓN JURÍDICA DE LAS OBTENCIONES VEGETALES (in Spanish)"

Es un repaso sobre los principales aspectos del régimen jurídico de la protección de propiedad industrial sobre obtenciones vegetales. Partimos de su diferenciación con respeto al sistema de patentes, el cual tratados de delimitar. Posteriormente se analiza el régimen jurídico del Convenio de la Unión de Internacional para la Protección de Obtenciones Vegetales (CUPOV), marco normativo a nivel mundial del sistema de protección específico sobre variedades vegetales. Acto seguido, analizamos la regulación comunitaria europea en la materia. Después, pasamos revista al régimen jurídico español, toda vez que su sistema jurídico es similar al nuestro. Por último, analizamos la Ley Federal de Variedades Vegetales de México y proponemos –con base en las legislaciones analizadas- reformas para adaptarla a las necesidades de la industria de la obtención.
