Fu approvata dall'Assemblea Costituente il 22 dicembre 1947 e promulgata dal capo provvisorio dello Stato Enrico De Nicola il 27 dicembre 1947. Fu pubblicata nella Gazzetta Ufficiale della Repubblica Italiana n. 298, edizione straordinaria, del 27 dicembre 1947 ed entrò in vigore il 1º gennaio 1948. Considerata una costituzione scritta, rigida, lunga, votata, compromissoria, laica, democratica e tendenzialmente programmatica, consta di 139 articoli (anche se sono stati abrogati gli articoli 115, 124, 128, 129, 130) e di 18 disposizioni transitorie e finali (Aonia edizioni).
