Le premier tome de De la démocratie en Amérique, publié en 1835, est composé de deux parties. La première est un exposé sur les institutions et les lois aux Etats-Unis: elle a beaucoup vieilli en raison du renforcement du pouvoir fédéral après la guerre de Sécession et, surtout, après la crise des années 30. La deuxième partie s'attache à montrer comment "le peuple gouverne" et le rôle des moeurs ("l'état moral et intellectuel d'un peuple") dans le maintien de la démocratie en Amérique.
