Synopsis "Teoría Evolutiva y Positivismo Jurídico: Un Matrimonio Posible. Serie Teoría Jurídica en Filosofía y Derecho n. ° 94 (in Spanish)"

El profesor Zamboni ofrece una interesante aproximación a la cuestión de la creación del derecho, mediante la combinación del modelo teórico de evolución y la comprensión positivista del derecho moderno. Nos muestra cómo el abordaje de un concepto de derecho positivo se puede complementar (como si se tratara de un matrimonio) con una concepción evolutiva del derecho que, a pesar de estar presente, no ha cumplido un papel central en las discusiones de teoría jurídica. Basado en este análisis, Zamboni evalúa si, tras realizar ciertos ajustes, es posible "casar" a la teoría evolutiva con el positivismo jurídico, y acogerla en "la gran familia del pensamiento jurídico" como teoría especial de producción del derecho.
